讲座前半部分是一个对英国诺丁汉大学法学院公共采购研究小组（Public Procurement Research Group ：PPRG）的简介：

公共采购研究小组是诺丁汉大学法学院的一个组成部分，其主要宗旨是增进社会对公共采购的知识和了解。该小组的具体活动包括：

→从事高质量的研究工作并出版研究成果；

→提供以具体实践和学术研究为目的的公共采购培训；

→组织并参与各种学术会议以及专题交流和研究活动；

→通过咨询服务支持高质量的公共采购实践。

一、从阿伯里斯特斯到诺丁汉

1996年，公共采购小组组建于威尔士大学阿伯里斯特斯分校，1998年9月迁移至诺丁汉大学法学院。作为全英国学术研究机构中的佼佼者，诺丁汉大学法学院在不久前由英国政府组织的一次学术研究评估活动中一举夺得满分，并由于其高水准的教学被评为“优秀”级法学院。在英国只有寥寥可数的几所学院获得这样的殊荣。

诺丁汉大学位于英国中部，交通位置极为便利，有铁路和公路通往首都伦敦，距东米德兰机场只有20分钟的路程，同时到伯明翰、曼彻斯特和伦敦各地的机场都十分方便。

二、公共采购研究小组主任：苏·阿诺史密斯教师

阿诺史密斯教授是在加拿大奥斯古德学院获得法理学博士学位，是欧盟政府采购咨询委员会的成员，期刊《公共采购法律评论》的主编，同时也是英国公共采购规范协会的发起人之一。她在公共采购领域著述甚丰，其著作主要有：《公共采购：全球革命》（1998），《政府采购及公共事业采购法》（1996），《实施公共采购过程中的赔偿问题》（1993），《政府采购案例指南》（1992），《政府采购及司法监督》（1988）。

三、学术会议及培训专题

每年，公共采购研究小组都会同阿基里斯信息公司举办一次为期两天的互动式专题讨论，主要内容是如何根据欧盟的规定从事公共采购活动。参加这些专业色彩很强的讨论活动的人士既有采购者也有律师。该活动的目的在于提高有关人员的采购技巧，强化并更新有关知识。在这些活动中，政府部门的公共采购和公用事业采购一般作为两个独立专题分别进行。

此外，公共采购研究小组还可根据具体情况举行各类专题会议，并可根据不同的需要提供合适的培训课程。

四、访问学者项目

公共采购研究小组设立了一项访问学者计划，主要对象是学术研究者，律师，采购者以及其他有志于从事公共采购研究的人员。公共采购研究小组不定期地为访问学者提供小额资助，尤其是来自发展中国家和过渡经济国家的学者。

五、学术研究和出版物

学术研究是公共采购研究小组的一项重要活动。该小组的成员出版了大量著作，专文和报告，内容十分广泛，有的侧重学术讨论，有的侧重实践，特别适合采购者和律师。最近出版的著作包括：《欧洲国防采购法》（克鲁默法律出版社1999）：由马丁特里比斯撰写的这部专著考察了欧洲国防采购有关规则的现状，并提出了一套为开放国防采购市场的解决办法。《公共采购：全球革命》（克鲁默法律出版社1998）：由阿诺史密斯教授和阿维戴维斯主编，这部论文集内容涉及国际公共采购规范中的许多重要问题，具有很大的启发作用。论题包括世界银行项目采购，联合国国际贸易法委员会（UNCITRAL）的公共采购示范法，区域性自由贸易协议和全球自由贸易协议框架下的政府采购问题，政府采购在实施社会发展和环境政策上的作用等等。

《政府采购及公用事业采购法律》（斯威特和马赛尔出版社1996）：阿诺史密斯教授著，本书全面论述了欧盟的公共采购指令及其在英国的实施情况，同时具体分析了欧盟指令中的“灰色”区域，并为立法和司法机构今后的完善工作提供了建议。

《欧盟公共采购法及其在十五个成员国的实施情况》（1996）：本报告是欧盟委员会针对其公共采购方针的影响从事的研究的一部分，同时也是对单一市场有效性总体评述的一部分。

《公共采购的法律规范：国内和国际视角》（克鲁默法律出版社1999）：本书由阿诺史密斯教授和理那瑞利、威勒斯合著，详细地分析了公共采购规范的所有方面，包括许多生动的解释性材料，材料来自各具特点的国际和国内采购政策体系，以及联合国国际贸易委员会的公共采购示范法。

《公共采购法律评论》：该书是一本跨学科的期刊，每年六期，由阿诺史密斯教授主编，公共采购小组的许多其他成员任联络员和评论编辑。本刊内容涉及世界各国，特别是欧盟和GPA签约国家在公共采购方面的最新发展，文章既有实践性的讨论，也有针对政府采购政策的分析，并包括了一个关注最新动态的专栏。

六、公共采购专业课程

诺丁汉大学法学院开设法学硕士学位（LLM）专业课程，具体专业方向包括欧盟法，国际法、国际商法等，在这些专业里学生都可以学习有关政府采购的课程。目前该院共有三门研究公共采购的课程：

公共采购：本门课程主要涉及国内体系下的公共采购规则，联合国国际贸易法委员会的公共采购示范法，以及世界银行的采购规则。

欧盟框架政府对市场进行干预的规则：本门课程以欧盟法对政府从事的不正当竞争行为的控制为背景，讨论公共采购问题。

这些课程可以和其他相关课程结合在一起学习，比如国际销售合同和融资法，欧盟法，世界贸易体系等等。LLM学生也可以以公共采购为题撰写学年论文。

本校除设置全日制的LLM课程之外，还要结合采购从业人员的半日制LLM课程，两套可选择的时间分别为十月至十二月，或一月至三月。

哲学硕士、哲学博士学位

学生如果希望研究公共采购法律申请哲学硕士或博士学位，法学院将在其研究中提供专业指导。这些研究学位课程既有全日制又有半日制。诺丁汉大学法学院研究学位课程的规模在英国屈指可数，任何时候都有约五十位来自世界各地的研究生在此攻读，在这里攻读学位的人员还可以充分受益于学校提供的各类出色设施。

New Deputy Directive and Lecture-in-Law ：The introduction of Dr Martin Trybus

In April 2000 the Public Procurement research Group welcomed as lecture in the School of Law Martin Trybus ，1st Staatsexamen(Belin)，LL.M，Ph.D. (Wales)

2nd Staatsexamen (Northrhine—Westphia).Initially appointed on temporary contract basis in April 2000，he was appointed to a permanent position in July 2000，and became Deputy Directives of the Group in December 2000.

The regulation of defence procurement is Dr.Trybus’s main research focus，but he is also interested in the European and international law aspects of public procurement law in general . He is the author of European Defence Procurement Law ，recently published in the European Monographs Series of Kluwer Law International. This book is based on a Ph.D. thesis written between 1995 and 1997 under the supervision of Professor Sue Arrowsmith. In 1998 the thesis received a “Special Distinction ” for having contributed to the harmonization of European regulations，as part of the Post-Doctoral Thesis Prize of the European Group of Public Law (seat：Athens). His next major project is on national security in European law . He has published and spoken on public procurement law in the United Kingdom，Germany，the Netherlands，Greece and Slovenia，and last summer rounded up his education in EC—public procurement law working for a public procurement unit in DG Internal Market of the European Commission in Brussels.

Dr.Trybus will be involved in the teaching of the School of Law’s postgraduate (LL.M.) modules in public procurement ，as well as in teaching in the general area of European law and in supervising PhD projects on public procurement law .

Regulating Public Procurement：

Because of its enormous economic importance and susceptibility to corruption ，public procurement – the purchase by government of goods and services – has come under increasing regulation . Spurred on by domestic policies ，trade agreements ，and international organizations such as the World Bank， a new international system to regulate this strategic economic force is rapidly evolving – a system .

In unprecedented depth ， three international leaders in public procurement law fully explain how the procurement award process must be managed to achieve its goals in today’s global market economy . Public Procurement: Global Revolution

Public Procurement ：Global Revolution，reflects the enormous changes that have occurred in the legal regulation of public purchasing over the last decade。 These changes have two main drivers . The first is the implementation of national reform programmes in public procurement ，especially in developing countries and those countries making the transition from planned to market economies ，which have been encouraged by international institution such as the World Bank and UNCITRAL. The second is the efforts that have been made to open up government procurement markets to international trade ，both through regional agreements and globally though the World Trade Organization. These agreements have required many states to modify their national procurement for the first time .
